station. back to school, children this newtown return to class as funerals continue for those killed in the sandy massacre. >> here's what people are talking about. classes resumed today for most students in newtown connecticut for the first time since friday's massacre. all schools reopened except for sandy hook elementary. complete coverage begins with randall pinkston reporting for wjz. a bus carrying students drove up to the high school in newtown connecticut as a grief stricken town to tried to get back to some sort of routine. the bus had a ribbon on it. police were on hand to make sure everything ran smoothly. >> i wouldn't send my children to school if i had the choice rite right now. i wouldn't. >> i think it's important that the children do go back to school. >> all schools except sandy hook elementary are open. the scene of the massacre will remain closed for months. when those children go back they will attend a school in a

nearby town. people lit candles to remember the lives cut short. they paid their respects at the memorial set up for the 26 victims. >> the grieving process continues here in newtown. the families of two more children are saying a final farewell today. >> mourners gathered at st. rose of lima church for the funeral of james mattioli. his family says he used to joke he was born four weeks early because he was hungry. jessica rekos will also be laid to rest. her family says she loved horses and had asked santa for cowboy boots and a cowboy hat. tonight there will be a wake for victoria soto. a teacher who shielded her students from the gunman. >> she was just the best person. she loved her family. she loved her family more than anything. >> it's one of several wakes planned for victims this evening. >> in newtown connecticut, ran dam pinkston. in the wake of the bloodshed, some say now is the time to implement new gun

control legislation. complete coverage continues with nancy cordis. >> shame on the nra. >> as demonstrators marched on nra headquarters phone calls poured in to congressional offices. >> okay so you're in support of gun control legislation? >> kentucky democrat john yarmouth says most of the calls have been in favor of new gun restrictions. as a democrat from a conservative southern state yarr mouth says he avoided the issue for the past six years but now he wants to reinstate the ban on assault weapons. >> nothing's going to bring back those 20 children and six courageous educators, but we can make sure that's our inspiration and battle cry, and i won't be quiet anymore. >> neither will senator joe mansion of west virginia. like yarmouth he has a record of being pro gun rights. he fired on a piece of

legislation once in a campaign ad. >> but after friday's shooting, mansion says there must be a way to limit the purchase of high capacity magazines. >> this is not about the second amendment to our constitution or taking guns away. it's about having an intelligent conversation. >> that conversation has dried up in recent years in the face of pressure from powerful groups like the national rifle association, the nra's lobbying budget is 66 times the amount the leading gun control organization, the brady foundation spends to lobby congress, but a new cbs news poll shows that in the wake of the shooting 57% of americans now back stricter gun laws, the highest percentage in a decade, even though less than half, 42% think new laws would have helped prevent the tragedy. mansion has an a rating from the nra. that could change now that he's come out in favor of some form of gun control.

noticing flames. no injuries were reported. the army psychiatrist accused of going on a deadly shooting spree at for the hood will stand before a new judge today. ron matz is in the newsroom with more on the hearing. >> reporter: assan will appear in military court for his first pretrial hearing in more than three months. he's charged with more than a dozen counts of murder following the 2009 rampage that killed 13 people, more than two dozen others were injured. his case had been put on hold since september after the former judge ordered him to shave his beard or be forcibly shaved before his court martial. assan who is muslim appealed the ruling. two weeks ago the u.s. court of appeals for the armed forces ousted that judge and overturned his order. jessica back to you. thank you. hassan was studying to be a psychiatrist here in maryland and faces the death penalty if convicted. what a difference a day makes. after a gloomy day yesterday

today is looking pretty nice. taking a live look outside where the sun is shining after a wet morning. wjz is live with first warning weather coverage. meteorologist bernadette woods is inside updating these very nice temperatures. >> it is pretty incredible that this is a december afternoon. we're going to start out with first warning doppler radar and tell you the rain is gone, a couple showers still to the west, still a chance for a shower as we head through the afternoon but not a widespread rain. as far as temperatures go, with this westerly wind kicking up, it is remaining mild. the winds are going to gust upwards of 20 to 30 miles per hour this afternoon, but it's 58 degrees in baltimore, 61 in d. c. and these temperatures are still rising this afternoon. for more on how this factors in for the next couple of days we sent it to martty. thank you very much. good afternoon everybody . let's go ahead and discuss whether it's going to be a wig weather event that is coming

down midweek this week. ultimately it's going to bring us showers on thursday and colder weather for the weekend, but you're going to be hearing a lot about it. pretty strong snowstorm the first of the season, and it's going to be a midwest deal. it's starting in north texas around i guess you would say the texarkana region if you will and pressing up towards the great lakes. for us it's just going to mean rain, maybe a couple of thunderstorms just out to our west. however, having said that, that low when it gets northeast is going to yank cold air into the region and could that set us up for maybe some wintery precip as we move toward christmas. still a lock -- long time away, but the table is being set for winter which starts on friday. meteorologist bernadette woods will be talking about how chilly it's going to be this weekend coming up shortly. thank you. with christmas one week away,

local police are trying to crack down on people trying to steal your identity. the identity theft protection agency life lock taught 150 law enforcement officers how to guard against the growing crime. maryland is ranked in any event in the nation for identity theft. if you're hitting the road expect to have company. according to aaa more than 40% of the 5 and a half million people in the washington region plan to travel 50 miles or more over the holidays. aaa says the average trip will be more than 700 miles and more than 90% of holiday travelers plan on driving. and still to come on wjz, eyewitness news at noon, a violent police standoff in pennsylvania comes to an end. whatwhat happened and the latest on the gunman. a judge rules on a request to pull thousands of samsung products off the shelves. >> and a cool and sunny tuesday one week before christmas. the updated first warning weather forecast is coming up.

comes to a violent end in pennsylvania. >> officers responded to the apartment complex. 24-year-old able roman was holed up inside and firing shots. he was found dead inside the building. one officer was shot but his injuries are not life- threatening. it's note not clear how roman died. there are signs the fiscal cliff deal may be getting close. danielle nottingham reports for wjz on president obama's latest counter offer to prevent year end tax hikes for middle class americans. >> house speaker john boehner met with fellow republicans this morning to discuss president obama's fiscal cliff proposal. the speaker also began work on a so-called plan b to prevent a tax increase in case he does not reach a deal with the white house before january 1st. >> our plan b would protect american taxpayers who make a million dollars or less.

>> the president initially insisted on letting tax cuts expire for households making $250,000 or more, but the new white house counter proposal raises that threshold to $400,000, and for the first time the president is willing to accept some reduction in future cost of living benefit increases for social security recipients. >> in addition to his negotiations with the president, boehner has another challenge, convincing gop conservatives to accept any increases in income taxes. many republicans believe tax increases will hurt small businesses. pedro alfonso owns a company that installs voice and da that network. he's willing to pay his share of higher taxes if he gets something in return. >> there has to be a reform in entitlement. there has to be a reduction in spending in terms of federal government spending. that includes civilian agencies, defense department so everybody has something at stake. >> even though the fiscal cliff

deadline is the end of the year, congress still needs time to vote on a deal to avoid taxes going up for all americans and across the board spending cuts. in washington, danielle nottingham wjz eyewitness news. in a statement, senate majority leader harry reed said boehner's plan b will never pass both houses. a new poll shows only about half of all americans believe a deal will actually be made before the end of the year. a federal judge is rejecting apples request to force samsung to pull several phone models off the shelves. they can continue selling three of the older generation smartphones that a jury believes ripped off technology apple used to create the iphone. they ordered them to pay more than a billion dollars in damage. the judge ruled that banning the phones would ultimately hurt the public. still ahead on wjz eyewitness news at noon, a sunny and breezy day out there. your complete first warning weather forecast is 21/2

welcome back. the rain is pretty much gone but there are a couple showers linger the still the chance for a shower or two as we head through the afternoon. we're already starting to see some sunshine out there. that's going to be the trend as we head through the afternoon and also tomorrow. once again, the clouds breaking up and other than just a shower or two that will move by quickly we're going to be

dealing with this breeze, but it's a warm one. temperature-wise it's 58 in baltimore, 61 in d. c. our average high is 45 degrees. we're already 13 degrees above that, and we are still rising this afternoon, and we've been showing you this for a while, but there's still a lot of mild air out there, and the darker colors are still locked up to our northwest. now in this forecast, they are eventually going to return but not quite yet. we get rid of this storm from today. that will be leaving us with this right in here. behind us some dry air for tomorrow, a little bit of a break and then we have another storm to our west. it's the one that marty was talking about at the beginning of the show. that storm when it approaches us is going to bring us rain. it's a snowstorm to our west, but thursday and friday we're going to get rain, very gusty winds and it gets out of here on friday but the cold air does return behind it. and as far as cold air goes we're talking about closer to our normal. we have small craft advisory in effect with those winds picking up. the forecast looks like this, 62 for our high, a slight

in today's health watch a new study finds that radio waves may be an effective way to control high blood pressure. research published in the journal circulation looked at patients who were not responding to medication had found that directing radio waves at the nerves around the kidneys lowered blood pressure for six months. more than 78 million americans battle high blood pressure which can be a major risk factor for heart attack and stroke. people tend to overindulge around the holidays. in an article, it measures the possible consequences analyzing population studies they say each day of smoking, indulging in a couple drinks eating red
